1. Introduction and Scope

Pilates House, LLC ("Pilates House," "us", or "we") respect your privacy and are committed to protecting it through our compliance with this policy. This policy describes the types of information we may collect from you or that you may provide when you visit the website found at https://www.oliviastuart.com (the “Site") or download or create an account on the The Optimist Pilates App (the "App") and our practices for collecting, using, maintaining, protecting, and disclosing that information. This Privacy Policy forms part of the Terms and Conditions of Use that govern your use of the Site and the End User License Agreement that governs your use of the App. This Privacy Policy applies only to information we collect in the App and on the Site.

This Privacy Policy does not apply to information collected offline or via other apps or sites, including those that may be accessed via the App or to information that you provide to or that is collected by any third party, even if collected via an app or site linked through the App or the Site. The other apps and sites and third parties may have their own privacy policies, which we encourage you to read before providing information on or through them. PILATES HOUSE IS NOT RESPONSIBLE FOR THE CONTENT OR PRIVACY PRACTICES OF ANY COMPANY OTHER THAN PILATES HOUSE, AND PILATES HOUSE IS NOT RESPONSIBLE FOR THE CONTENT OR PRIVACY PRACTICES OF ANY NON-PILATES HOUSE SITE OR APP TO WHICH THE SITE OR APP LINKS OR WHICH LINK TO THE PILATES HOUSE SITE OR APP.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. IF YOU DO NOT AGREE, PLEASE DO NOT DOWNLOAD, ACCESS, OR USE THE SITE OR APP. By downloading, accessing, creating an account on, or using the Site or App, or by clicking "I agree," you agree to this Privacy Policy. 

This Privacy Policy may change from time to time. New versions of the Privacy Policy will be posted on the Site. Your continued use of the App or the Site after we revise the Privacy Policy is deemed to be acceptance of those changes, so please check the Privacy Policy periodically for updates. 

2. Children Under the Age of 13

The App and the Site are not intended for children under 13 years of age without parental oversight. No one under age 13 may provide any personal information to the App or the Site. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the Site or through the App, create an account on the App, or make any purchases on the Site or through the App or provide any information (including name, address, phone number, email, screen name or user name) to Pilates House. If we learn we have collected or received personal information from a child under the age of 13 without verification of parental consent, we will delete that information. If you believe we might have any informa t ion f rom or about a chi l d under 13, please contact us at info@theoptimistpilates.com. Any information we collect about children under the age of 13 must come from that child’s parent or guardian or with authorization from that child’s parent or guardian only. If you would like your child under the age of 13 to become a student and allow us to accept information about that child, please complete and sign the applicable forms offline.

3. Information We Collect and How We Collect It

(a) We collect information from and about users of the App and the Site, including information:

  • By which you may be personally identified, such as name, postal address, email address, telephone number, or birthdate ("personal information");

  • That is about you but individually does not identify you ("non-personal information"). Non-personal information may include information derived from personal information that has been de-personalized by removing unique identifiers and/or combining it with information about other users to form

  • aggregated data;

  • About your internet connection, the equipment you use to access the App and our Site, and usage details.

(b) We collect this information:

  • Directly from you when you provide it to us (such as when you fill out a form, contact us, become a member, sign up for a class or event, or a private session, or sign up for a Balanced Body course);

  • Automatically as you navigate through the App or Site. Information collected automatically may include usage details, IP addresses, and information collected through cookies and other tracking technologies.

4. Information You Provide to Us

(a) The information we collect on or through the App and the Site may include:

  • Information that you provide by filling in forms on the App or the Site. This includes information provided to: create an account; establish a membership; register for a Pilates group class, private session, Balanced Body teacher training, or other event; or contact us. We may also ask you for information

  • when you enter a contest or promotion sponsored by us, and when you report a problem with our App or Site.

  • Records and copies of your correspondence (including email addresses and phone numbers), if you contact us.

  • Your responses to surveys that we might ask you to complete.

  • Details of transactions you carry out through the App or the Site and of the fulfillment of your orders. You may be required to provide financial information before placing an order through the App or the Site.

  • Location information, including location information provided by a mobile device or other device as you navigate the Site or App;

  • Activity information about your use of the Site or App;

  • Usage, viewing, technical, and device data when you visit the Site or App or interact with communications from the Site or App.

5. Information We Collect Through Automatic Data Collection Technologies

(a) As you navigate through and interact with the App and the Site, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits and usage of the App and the Site, including traffic data, location data, and other communication data and the resources that you access and use on the App and the Site;

  • Information about your device and internet connection, including the device’s unique identifier, your IP address, operating system, browser type, and your phone number; and

  • Information about the location of your device to allow you to check in to a class. You may be required to enable location access to use the check-in feature on the App.

(b) The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on your device. You may refuse to accept browser cookies by activating the appropriate setting on your browser or mobile cookies by activating the appropriate setting on your device. However, if you select these settings, you may be unable to access certain parts of the App or the Site. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to the Site.

  • Web Beacons. Pages of the App and the Site and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity). Although you cannot decline to receive web beacons and pixels when visiting a web page, you can choose not to receive them by email if you disable HTML images or refuse HTML email messages.

(c) The information we collect automatically does not include information that identifies you individually, but we may collect information about the device you are using or that identifies your device (e.g., IP address) automatically and associate non-personal information collected automatically with personal information you provide or that we collect from other sources. 

(d) Google Analytics and Google Advertising. We may use Google Analytics to assist with collecting and monitoring data about website traffic and usage and collect visitation information and identifiers via browser cookies. We may use Google Analytics for search term optimization, content analysis, website development, and improving the online shopping experience. This Site also uses Google Advertising and analytics, which include tracking of advertisements on the Google search engine and on other sites which display custom Google-hosted advertisements, and provides aggregated demographic and interest reporting. If you would like opt-out of the Google Advertising Features, you can adjust your Ad Settings and Ad Settings for mobile apps. (e) Stripe. We use Stripe for payments, analytics, and other business services. Stripe may collect personal data including via cookies and similar technologies. The personal data Stripe collects may include transactional data and identifying information about devices that connect to its services. Stripe uses this information to operate and improve the services it provides to us, including for fraud detection, loss prevention, authentication, and analytics related to the performance of its services. 6. How We Use Your Information

(a) We may use information that we collect about you or that you provide to us, including any personal information for any or all of the following purposes:

  • To provide you with the App and the Site, including the contents of each, and any other information, products, or services you request from us;

  • To provide you with notices about your account/membership, including expiration and renewal notices;

  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;

  • To notify you about changes to the App or Site are available or when changes to our service offerings described in the App or Site are made;

  • To contact you with class reminders, scheduling confirmations, promotions/ specials, goods and services that may be of interest to you, and other related information;

  • To provide you with an efficient system for purchasing classes, signing up for classes, rescheduling, and cancelling classes, and other sessions and events;

  • To store information about user preferences, and improve and customize user experience;

  • To facilitate your use of the App’s auto check-in functionality;

  • To fulfill any other purpose for which you provide such information;

  • In any other way we may describe when you provide the information; and

  • For any other purpose with your consent.

7. Disclosure of Your Information

(a) We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction.

(b) We may disclose personal information that we collect or you provide:

  • To contractors, service providers, and other third parties in order for them to provide services and support to our business such as Marina Tek, Apple, Google, Stripe, and Balanced Body.

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Pilates House's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information

  • held by Pilates House about users of the App and/or Site is among the assets transferred.

  • To fulfill the purpose for which you provide it.

  • For any other purpose disclosed by us when you provide the information.

  • With your consent.

(c) We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • To enforce our rights arising from any agreements entered into between you and us, including without limitation the End User License Agreement and the Terms of Use as well as for billing and collection.

  • If we believe disclosure is necessary or appropriate to protect our rights, property, or safety, that of our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

(d) Upon your written request to info@theoptimistpilates.com, we will erase your personal information. This will mean you can no longer sign up for classes, sessions, or other events.

8. Choices About How We Use and Disclose Your Information

(a) We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Do Not Track. The Site does respond to do-not-track (DNT) signals from browsers or other similar mechanisms. You may select a "do not track" setting on your web browser. However, these features are not yet uniform, so we may not currently respond to such features or signals. Therefore, if you select or turn on a "do not track" feature in your web browser, we and our third-party providers may continue collecting information about your online activities as described in this Privacy Policy. We do not permit third party advertisers to collect personally identifiable information about your online activities for

  • their own use when you use the App or the Site.

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the App or the Site may then be inaccessible or not function properly.

  • Location Information. You can choose whether or not to allow the App to collect and use real-time information about your device’s location. If you block the use of location information, some parts of the App or Site may become inaccessible or unavailable for your use. For example, auto check-in will not work if you restrict the App from accessing your location.

  • Erasing Information, Updates. You may contact us at info@theoptimistpilates.com to request deletion of certain personal information that you have provided to us or to update your information.

  • Options to opt-out and unsubscribe. We may use your personal information to send you marketing and promotional emails/texts, newsletters, or other information that may be of interest to you. You may opt out of receiving email and text marketing communications by using the unsubscribe link in our email communications (or following the unsubscribe instructions in a text). Please allow us reasonable time to process your opt-out request. Also note that even if you opt out of receiving email/text marketing communications from us we may still contact you via email and text for non-marketing purposes such as class reminders, scheduling or cancellations, or to provide legal notices or fulfill legal obligations.

(b) We do not control third parties' collection or use of your information to serve interest-based advertising. Third party online advertising networks may collect information about your use of our websites over time so that they may play or display ads that may be relevant to your interests on our Site or App as well as on other websites or services. Typically, the information is collected through cookies or similar tracking technologies. If you wish to opt-out of collection of such information through third party cookies, plug ins, or other tracking technology you may be able to do so by actively managing the settings on your browser or mobile device. Please refer to your browser's or mobile device's technical information for instructions on how to delete and disable cookies, and other tracking/recording tools. Depending on your mobile device, you may not be able to control tracking technologies through settings.

9. Data Security

(a) We work with services providers to try to protect financial information you supply to pay for services via encrypted via Secure Socket Layer (SSL) technology.

(b) The safety and security of your information also depends on you. Where you have chosen a password for access to certain parts of the App or the Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

(c) Unfortunately, the transmission of information via the internet is not completely secure. We cannot guarantee the security of your personal information transmitted to the App or the Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the App or the Site.

10. Changes to Our Privacy Policy

We may update the Privacy Policy from time to time. If we make material changes to how we treat our users' personal information, we will post a notice on the App’s home page and post a copy of the updated Privacy Policy on this page of the Site. 

The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable contact information for you and for periodically visiting this Privacy Policy to check for any changes.
