Liability Waiver & Photo Release

In attending Pilates House LLC DBA The Optimist Pilates located at 2719 19th Pl S Birmingham, AL

35209, I agree that I do so at my own risk. I assume full responsibility for any injuries or damages which

may occur to me using studio facilities and equipment, and I hereby fully and forever release and

discharge Pilates House LLC, its owners, employees, and members from any and all claims, demands,

damages, rights of action, or causes of actions, present or future, whether the same be known or

unknown, anticipated or unanticipated, resulting or arising out of my or a member's use or intended use

of the facilities and equipment of Pilates House LLC. I hereby agree that I understand that there are

inherent risks involved in the Programs, including the risk of serious physical injury and death and I fully

assume all risks associated with the Programs, including: intensive physical activity and exertion,

causation or aggravation of a physical injury or medical condition, lack of warnings or inadequate

warnings: lack of instructions, inadequate instructions, or my failure to follow instructions: slipping from

slippery surfaces such as mats or floors; equipment failure; and the like. I am fully aware of and accept

the risks and hazards involved, and agree to assume full responsibility for any risks, conditions, injuries

or damages, known or unknown, which I might incur or aggravate as a result of my participation in the

program.

In consideration of being permitted to use the facilities and equipment located at Pilates House LLC, I

agree that Pilates House LLC shall not be liable for any damages arising from any personal injuries

sustained by any guest or member on or about the premises of Pilates House LLC Pilates studio. I

warrant, represent, and agree that I am in good physical condition and have no disability, impairment, or

ailment preventing me from engaging in active or passive exercise that will be detrimental to health,

safety, comfort, or physical condition if I do so engage or participate. If my health condition changes or I

become pregnant, I agree to inform Pilates House LLC. I will take responsibility for my health and safety

and avoid any exercises I have been advised by my physician not to do. Pilates House LLC shall not be

liable for the loss or theft of, or damage to, the personal property of a guest or member.

I understand that there are inherent risks in all aspects of physical exercise, and I acknowledge that I

have been informed of the possible strenuous nature of training. I agree that prior to my participation I

will inform Pilates House LLC of any known medical conditions or factors that may place me at risk.

Pilates House LLC may request a medical release from my medical practitioner prior to participation. I

will inform Pilates House LLC of any symptoms before, during and after participation in a Pilates House

LLC class.

I also understand that if I am a prenatal or postnatal client, that I must consult with my physician and

receive clearance to perform physical exercise.

I release Pilates House LLC and its staff, employers and agents from any and all liability for any loss,

damage, injury or expense that I may suffer, or that my next of kin may suffer as a result of my

participation in the classes, activities and services provided by Pilates House LLC.

When visiting Pilates House LLC or send emails to us, you are communicating with us electronically, and

therefore consent to receive communications from us electronically. We will communicate with you by

email or by posting notices on our website and social media channels. You agree that all agreements,

notices, disclosures, and other communications that we provide to you electronically satisfy any legal

requirement that such communications be in writing.

Photo Release

Pilates House LLC may photograph and record you. They may publish and distribute these photographs

and recordings in connection with your participation in Pilates House LLC activities and your attendance

at Pilates House LLC facilities. By acknowledging these terms, you agree and consent that Pilates

House LLC may display these photographs and recordings through our website and social media

channels.

TERMS & CONDITIONS

We recommend you consult with a physician before starting this or any exercise program. If you

experience any pain or discomfort during the course of the program, stop exercising immediately and

seek medical attention. Prenatal/postnatal clients must consult with their physician and have received

verbal clearance to perform physical exercise. All sessions and classes are 50 minutes in length. Private

sessions require a 24-hour cancelation notice. If you do not show or do not cancel or reschedule your

class/session within the cancelation period, you will be charged the full rate. All sessions and packages

are non-transferable and non-refundable.
